SENCO and SEND Leader survey: Dyslexia and SEND reform

1. Summary

Organised jointly by the British Dyslexia Association (BDA) and Giglets Ltd (t/a ILT Education UK), this survey seeks to gather insights from SENCOs and SEND leaders across England regarding dyslexia provision and the Government’s proposed SEND reforms.

We do not collect your name or the name of your setting, and all survey responses are compiled into an aggregated report. Providing an email address is entirely optional; if shared, it will be used exclusively for your selected preferences and separated from your survey data prior to analysis.

This privacy notice details the types of data collected, the legal rationale and purpose, access restrictions, retention schedules, and your individual rights.

The BDA and ILT are joint controllers of the personal data collected through this survey. This means we decide together why and how your survey answers, and any email address you give us for a follow-up conversation, are used, and we are both responsible for protecting them.

Our responsibilities for the survey have been allocated between both parties. As the survey host, ILT serves as the primary contact for inquiries or requests regarding your personal data. Nevertheless, you may reach out to or exercise your data rights with either organisation. Should you choose to contact the BDA, they will collaborate with ILT to address your request.

If you ask to receive updates, the organisation you choose becomes the sole controller of your email address for that purpose. If you tick the BDA box, the BDA alone is responsible for how it uses your email address in its mailing system. This is explained in the BDA’s privacy policy. If you tick the ILT box, ILT alone is responsible for how it uses your email address in its mailing system. Neither organisation is responsible for the other’s mailing list.

What we do not collect

We do not ask for your name, the name of your setting, or any information about individual pupils. The survey does not require you to sign in, and it is set up so that it does not record your Google account details.

Please do not name pupils, staff or your setting in your written answers, and please do not include information about anyone’s health or special educational needs that could identify them. If you do, we will delete that detail from our records when we find it, and it will not appear in any report.

Can your answers identify you?

Your role, setting type, region and years of experience are not intended to identify you. However, if only a few people with the same combination of answers take part, it may be possible to work out who someone is. That is why we treat all survey answers as personal data and protect them accordingly, and why we will not publish results for small groups (see section 7).

4. Why we use your information and our lawful basis

Data protection law requires us to have a lawful basis for each use of your personal data. The table below sets these out.

What we do

Lawful basis (UK GDPR)

Our legitimate interests

The BDA is a charity whose work includes representing the needs of people with dyslexia and informing Government policy. ILT provides literacy resources to schools and has an interest in understanding how schools identify and support pupils with literacy difficulties, and in contributing evidence to the sector. Both organisations have an interest in publishing independent evidence on how the proposed SEND reforms may affect pupils with dyslexia.

We have considered whether these interests are outweighed by your rights and interests. We believe they are not, because we do not ask for names, the questions concern your professional views rather than your private life, we report findings in aggregate only, and taking part is voluntary.

How ILT Education will and will not use your answers

ILT is a commercial education technology company. We want to be clear about what that means for you. ILT will not use your survey answers to identify you or your setting for sales purposes, will not use them to build a profile of you, and will not add your details to any sales or marketing system unless you tick the ILT box in the “Staying involved” section.

Do you have to give us your information?

No. There is no requirement to take part. If you choose not to answer the required questions, you will not be able to submit the survey. If you choose not to give an email address, we will not be able to contact you or send you updates.

Automated decision-making

We do not use your information to make any decision about you by automated means, and we do not use it for profiling.

Special category data

We do not intend to collect special category data, such as information about anyone’s health or disability. If any appears in a written answer, we will delete it when we find it and will not use it.

5. How we handle your email address

Because email addresses and survey responses are gathered in the same form, both are temporarily stored together within ILT's secure Google account, accessible solely by designated staff assigned to the survey.

Within 5 working days of the survey closing, and before any analysis begins, ILT will:

  • move all email addresses and contact preferences into a separate file with restricted access; and
  • delete them from the survey answers.

From that point, the survey answers used for analysis contain no email addresses. We will not try to link your answers back to you.

We then use your email address only for the options you ticked:

  • Follow-up conversation: a member of the BDA or ILT team working on the survey may contact you.
  • BDA updates: ILT passes your email address to the BDA, which adds it to its supporter database (CRM) and uses its email platform (Mailchimp) to send you updates. ILT will not use it for its own marketing. For how the BDA uses your information once you join our mailing list, see our privacy policy.
  • ILT updates: ILT adds your email address to its mailing system (HubSpot). The BDA will not use it for its own marketing unless you also ticked the BDA box.

Every message we send will include a way to unsubscribe.

6. Who can see your information

Your survey answers can be seen by a small number of named staff at the BDA and ILT who are working on the survey. We share the analysis file (with email addresses removed) between the two organisations.

We also use the following service providers, which process data on our instructions under written contracts:

Provider

What they do

Which data

Google (Google Workspace)

Hosts the form and stores responses for ILT.

All survey data.

HubSpot

ILT’s mailing and contact system.

Email addresses of people who ticked the ILT box only.

Access Charity CRM (The access Group)

The BDA’s contact database.

Email addresses of people who ticked the BDA box only, with a record of their consent .

Mailchimp (Intuit)

The BDA’s email platform

It sends updates to people who ticked the BDA box.

We do not sell your personal data, and we do not share it with anyone else unless the law requires us to.

7. What we publish

We will publish findings as aggregate data only, such as statistics and summaries of the broad themes in written answers. We may publish short extracts from written answers, edited to remove anything that could identify a person or setting, and never attributed. Both organisations may refer to the published aggregate findings in their own work

We will not publish results for any group of fewer than 5 respondents, for example a particular role within a particular region, where doing so could make it possible to identify someone. In those cases we will combine groups or leave the result out.

8. Transfers outside the UK

Some of our service providers, including Google, HubSpot and Mailchimp, are based in the United States or may process data outside the UK. Where your data is transferred outside the UK, it is protected by appropriate safeguards required by UK data protection law. These are the UK Extension to the EU-US Data Privacy Framework, where the provider is certified under it, or the International Data Transfer Addendum to the European Commission’s Standard Contractual Clauses. You can contact us for more information about these safeguards or read our full company privacy notice and sub-processor list here.

9. How long we keep your information

Information

How long we keep it

Survey answers (with email addresses removed)

Until 31 December 2027, then securely deleted.

Email addresses and contact preferences held for the survey

Separated from survey answers within 5 working days of the survey closing. Deleted by 31 December 2027, or sooner once no longer needed.

Email addresses for a follow-up conversation

Deleted once the follow-up is complete, and in any case by 31 December 2027.

Email addresses added to the BDA CRM and mailing system or ILT mailing system

Until you unsubscribe or withdraw consent. We keep a record of when and how you gave consent for as long as we rely on it. If you unsubscribe, we keep a minimal record so that we do not contact you again.

Published aggregate findings

Kept indefinitely. These do not contain personal data.

10. How we keep your information secure

We store survey data in access-controlled accounts, limit access to named staff working on the survey, separate email addresses from answers before analysis, and use appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access.

11. Your rights

Under UK data protection law, you have the right to:

  • ask for a copy of the personal data we hold about you (right of access);
  • ask us to correct inaccurate data (right to rectification);
  • ask us to delete your data (right to erasure);
  • ask us to limit how we use your data (right to restriction);
  • object to our use of your data where we rely on legitimate interests (right to object);
  • withdraw your consent at any time, where we rely on consent. This does not affect anything we did before you withdrew it; and
  • receive data you gave us on the basis of consent in a portable format (right to data portability).

Your right to object. Where we rely on legitimate interests, you can object to our use of your survey answers at any time, on grounds relating to your particular situation. You can also stop marketing messages at any time by unsubscribing, and we will always comply.

These rights are not absolute, and some apply only in certain circumstances.

Because we do not collect names, we can only find your survey answers if you left an email address and you contact us before we separate email addresses from answers (within 5 working days of the survey closing). After that, we cannot tell which answers are yours, so we cannot find, correct or delete them. In that case, your answers will only ever be used in aggregate. If you did not leave an email address, we cannot identify your answers at any point.

To make a request, email info@ilteducation.com or info@bdadyslexia.org.uk. We will respond within one month, which may be extended in limited circumstances. We will tell you if that happens.

12. Complaints

You have the right to complain to us if you are unhappy with how we have used your personal data. Email info@ilteducation.com with "Survey data complaint" in the subject line. We will acknowledge within 30 days and keep you informed until we reach an outcome.

About BDA updates: if your complaint is about emails you have received from the BDA after ticking the BDA box, email info@bdadyslexia.org.uk with “Survey data complaint” in the subject line. The BDA will acknowledge your complaint within 30 days and keep you informed until we reach an outcome.

You also have the right to complain to the Information Commissioner’s Office (ICO), the UK’s data protection regulator: ico.org.uk/make-a-complaint, telephone 0303 123 1113.
